Cabinet approves draft law on rights of users of health services and medical liability

Tunis: The Cabinet meeting chaired by Prime Minister Ahmed Hachani at the Government Palace in Kasbah on Monday approved a draft law on the rights of beneficiaries of health services and medical liability.

Health Minister Ali Mrabet presented the draft law, which aims to establish a specific legal framework to balance the rights of patients and the rights of medical staff.

The bill also aims to protect the rights of users of health services in general, the mechanisms of prevention of risks and damages related to treatment, the medical liability system for health professionals in their activities, and the responsibility of public and private health structures and institutions in the provision of health services.

The draft law is part of the effort to create a unified legal framework for the above-mentioned rights, on the one hand, and to fill the legislative vacuum in the national legal system on the subject of medical liability, on the other.

The meeting also approved a number of draft decrees, in particu
lar a draft decree supplementing Decree No. 2352 of October 17, 2000 to make the provisions of Decree No. 1690 of July 17, 2000 regulating the status of public health nurses applicable to the civilian health personnel of the Ministry of National Defence.

It also approved a draft decree regulating the special procedures applicable to public procurement in connection with the organisation of the 13th General Population Census and a draft decree regulating the continuous training of employees of the State, local authorities and public institutions of an administrative nature.

The Cabinet approved a draft decree amending Decree No. 187 of April 5, 2024 on the administrative and financial organisation of the National Anti-Doping Agency and its operating procedures.
