Post: ODPP Urges Collaborative Efforts for Effective Case Prosecution

Narok: The Office of the Director of Public Prosecutions (ODPP) in Narok town has called on justice stakeholders to collaborate to ensure criminal cases are successfully investigated, prosecuted, and charged in a court of law.

According to Kenya News Agency, the Narok ODPP in-charge, Gitonga Murang'a, highlighted the roles of police, local administrators, advocates, and witnesses in delivering justice to victims. He criticized public pressure for preferred charges, emphasizing that only the ODPP is constitutionally authorized to draw charges.

Murang'a recalled that prior to the 2010 constitution, prosecutors were police officers. However, after the current constitution's enactment, prosecutors became professional lawyers equipped to advise on legal proceedings. He noted that not all cases should go to court, as prosecutors determine whether cases should proceed to criminal court, civil court, or the Alternative Justice System (AJS).

He advised that cases such as land disputes should be directed to the Environment and Lands Court for resolution rather than taken to criminal court. Murang'a reiterated his role as the chief legal advisor on criminal matters, emphasizing the need for cooperation between justice stakeholders to achieve swift justice for victims.

Murang'a also stressed the importance of public cooperation in providing sufficient evidence for arrests and investigations. He pointed out the challenge of witnesses withdrawing from testifying, which hampers court proceedings.

He advised dissatisfied members of the public to file formal complaints with his office rather than expecting court judgments to always be in their favor, urging respect for court decisions.

This advice comes following the arrest of three individuals found in possession of stolen goods, amid public demands for charges of robbery with violence.
